Court Hears Company’s Rebuttal Of Illegal Tenancy  

Nitrade Limited has denied it is occupying illegally a section of a warehouse belonging to Great Nigeria Insurance Plc. The defendant, Nitrade Limited, in a counter-affidavit filed, disproved the claim of illegal occupation of the property, located at 17 Morrison Crescent, Oregun, Ikeja.

In the case before the Ikeja Magistrate Court, Kadiri Adebayo, a senior executive of Great Insurance Plc, on behalf of Great Nigeria Insurance, is requesting a year rent of eight million, one hundred and fifty thousand Naira (N8.150million), from Nitrade Limited for trespassing on the property.

However, Nitrade Limited argued it had an existing tenancy with the GNI, which owns the warehouse. Counsels to the defendant, BA Dada and Mudashiru Ayo, tendered an exhibit before the court to show Nitrade Limited was occupying the affected section of the warehouse based on agreed terms with GNI.

The defense counsels also said it was wrong for the GNI to demand a full year rent from Nitrade Limited since it is only occupying the rear of the warehouse hitherto used a former tenant, Industrial Flavour Limited. They urged the court to dismiss GNI’s claim, which they said was falsehood and lacked evidence.

Presiding Magistrate Aje-Afwa adjourned cross-examination on the suit to November 14.
